Back on January 22, a pedestrian was fatally struck while crossing Shields Street in Fort Collins, and on Wednesday (Feb. 4) police announced who was at fault. As it turns out, both the pedestrian and the driver of the red Ford sedan were deemed to be at fault.

According to the Coloradoan, video evidence gathered at the scene showed 30-year-old Kyle Hibler stepping out on to Shields attempting to cross with a red "do not walk" signal. At the same time, 29-year-old Christopher Gribble drove his sedan through the intersection as the traffic light turned yellow. Gribble made contact with Hibler in the intersection, launching him several yards. The impact shattered the frost covered drivers side window.

Gribble has been issued municipal court summons, cited for driving with an obstructed view, and had Hibler survived, he would have been cited for disobeying a pedestrian control signal.
